1. Agreement to Terms

By downloading, installing, or using WaveLux ("the App", "we", "us", "our") — available at wavelux.gamemagic.org and on the Google Play and Apple App Store — you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use the App. These terms apply to all users — free and premium alike.

2. Description of the App

WaveLux is a real-time fluid physics simulation and interactive games app. It provides:

• Fluid Physics Games — 20+ interactive games powered by a custom WebGL Navier-Stokes fluid solver running entirely on-device.
• Image Effects Suite — 20+ real-time visual effects (fire, glass shatter, ink bleed, neon glow, oil paint, and more) applied to photos from your camera or library.
• Marine Life Games — creature-based fluid interaction games (fish herding, jellyfish guiding, shark evasion, pearl diving, and more).
• Ambient Soundscapes — an immersive layered audio engine with on-device sound processing.
• Premium Content — additional games, effects, and levels available via in-app purchase.

3. Eligibility

To use WaveLux, you must:

• Be at least 4 years old (or have parental or guardian consent if required by your jurisdiction for in-app purchases).
• Have a compatible Android or iOS device.
• Comply with the terms and policies of your respective app store (Google Play or Apple App Store).

If you create an account, you must provide accurate registration information and maintain the security of your credentials. We reserve the right to refuse or terminate access at our sole discretion.

4. Free Tier and Premium Content

WaveLux is available in two tiers:

• Free Tier — core fluid games, a selection of image effects, and ambient soundscapes. No account required.
• Premium — additional game levels, the full image effects library, exclusive marine life games, and advanced soundscapes, available as in-app purchases. Premium content is tied to your device/account and is non-transferable.

All in-app purchases are processed by Google Play or the Apple App Store. Prices are displayed in the checkout flow and may change at any time; any price change does not affect purchases already made.

5. Refund Policy

All in-app purchases are final. Because premium content is delivered digitally and access is granted immediately upon purchase, we do not offer refunds.

Exception: If a technical fault on our part prevents you from accessing purchased content, contact us at [email protected] and we will work to resolve the issue or, where appropriate, process a refund.

You may also request refunds directly from Google Play or the Apple App Store in accordance with their respective refund policies.

6. Intellectual Property

The WaveLux app — including its code, graphics, game designs, fluid simulation engine, sound assets, and all associated content — is protected by copyright and other intellectual property laws and is owned by WaveLux. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

You may not:

• Reverse-engineer, decompile, or disassemble the App.
• Copy, distribute, or create derivative works from the App's code or assets.
• Use the App for commercial purposes without our written consent.
• Remove or alter any copyright, trademark, or proprietary notices.

Screenshots and screen recordings of your WaveLux session may be shared on social media for personal, non-commercial purposes.

7. Acceptable Use

When using WaveLux, you agree not to:

• Attempt to gain unauthorised access to our servers or infrastructure.
• Use automated tools, bots, or scripts to interact with the App.
• Exploit bugs or glitches in a manner that disrupts other users or our systems.
• Impersonate WaveLux or any other person or entity.
• Use the App in any way that violates applicable local, national, or international law.

8. Privacy

Your use of WaveLux is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

9. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

To the maximum extent permitted by law, WaveLux shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above. Continued use of the App after changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the jurisdiction in which WaveLux operates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
